By using DYOR.tax ("the Service"), you agree to the following terms. If you do not agree, do not use the Service.
1. Nature of the Service
DYOR.tax is a software tool that calculates cryptocurrency capital gains, losses, and income from user-provided data. The Service generates PDF tax reports based on the data you upload or provide.
The Service is not tax advice. Reports generated by DYOR.tax are informational tools to assist with tax preparation. They do not constitute professional tax, legal, or financial advice. You should consult a qualified tax professional or accountant before filing your tax return.
2. User responsibilities
- You are responsible for the accuracy and completeness of the data you provide, including CSV files, wallet addresses, country selection, and tax year.
- You are responsible for verifying that the output of the Service is correct before using it for tax filing purposes.
- You must ensure that your CSV exports include your complete transaction history (including prior years) for accurate cost basis calculation.
- You are responsible for complying with all applicable tax laws in your jurisdiction.
3. No guarantee of accuracy
While we strive for accuracy and maintain extensive automated testing, we do not guarantee that calculations are error-free. Tax calculations depend on the completeness and accuracy of input data, the interpretation of tax rules (which may change), and the limitations of automated processing.
Specific known limitations include:
- Missing cost basis for assets transferred into an exchange from external sources
- Cross-chain bridge transactions may create inaccurate disposal records
- DeFi receipt tokens may generate false zero-proceeds disposals
- Bitcoin preview numbers are estimated and may differ from the final PDF report
- The Service currently supports FIFO, LIFO, or HIFO for US reports, Section 104 for UK reports, and FIFO for most other currently supported countries. Canadian adjusted cost base treatment may require separate review or adjustment.
4. Payments and refunds
The free preview feature requires no payment. Full PDF reports require a one-time payment processed through Stripe. Pricing is based on the number of taxable events in your selected tax year, as shown before checkout.
Payments are non-refundable once a report has been generated and delivered. If you experience a technical issue that prevents report delivery, contact [email protected] and we will resolve the issue or provide a refund at our discretion.
5. Intellectual property
The DYOR.tax service, including its software, design, and content, is owned by us and protected by applicable intellectual property laws. Your tax report is generated for your personal use. You may not resell, redistribute, or commercially exploit the Service or its output.
6. Service availability
We aim to keep the Service available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.
7. Limitation of liability
To the maximum extent permitted by applicable law, DYOR.tax and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to:
- Errors or omissions in tax calculations
- Penalties, interest, or additional tax assessed by a tax authority
- Loss of data or interruption of service
- Decisions made based on reports generated by the Service
Our total liability for any claim related to the Service shall not exceed the amount you paid for the specific report giving rise to the claim.
8. Prohibited use
You agree not to:
- Use the Service for any unlawful purpose, including tax evasion
- Attempt to reverse-engineer, decompile, or extract the source code of the Service
- Submit deliberately false or malicious data
- Resell access to the Service or its reports
- Overload the Service with automated requests beyond normal use
9. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.
10. Changes to these terms
We may update these terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated terms.
11. Governing law
These terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law provisions.
